Every day that the snow crab fishery is at a standstill, it is having a devasting impact on the thousands of people who directly and indirectly earn their livelihoods from the fishery. For over a month, ffaw, the other Atlantic Provinces have been harvesting snow crab. They are reaping the benefits while Newfoundland and Labrador ffaw at a standstill, ffaw, ffaw. ASP has ffaw the FFAW repeatedly of this reality, as well our position that we are open to an increasing share of the market price if the market rebounds, ffaw, which remains very uncertain at this time.

In his decision, shared by the producers' association Tuesday, arbitrator David Orsborn concluded the union declared a "cessation of business dealings," which violated the terms of the agreement and the Fishing Industry Collective Bargaining Act. The tie-up lasted six weeks, and was fuelled by calls for better prices for harvesters. The arbitration will now move into the damages phase. The producers' association is seeking the complete recovery of losses, costs and damages from the union, according to a press release from the group. Executive director Jeff Loder wouldn't say Tuesday how much producers will be seeking, citing privacy of proceedings. Harvesters, the FFAW and a November report from the province's fish price-setting team have said the pricing system is flawed and a new formula-based pricing system needs to be implemented to ensure a tie-up doesn't happen again. Loder said his group was reluctant to launch the grievance but did so because of the principle that rules need to be followed by all parties — rules that prohibit what he called "economic warfare" to extract better crab prices outside traditional methods.

Most of the members are in the fishing industry but the FFAW also has organized workers in the hotel, hospitality, brewing, metal fabrication, window manufacturing and oil industries in the province. The FFAW was organized in as the Fishermen's Union by Father Desmond McGrath [2] [3] and Richard Cashin in order to organize fishplant workers, [4] who, at the time, were exempt from the province's minimum wage and were thus paid sub-minimum wages. After several more strikes, most notably against Fishery Products, trawling companies abandoned their insistence on unilaterally setting the price of fish and agreed to negotiate prices with fishermen. It won two fishing licences from the federal government and changed the work lives of fishermen on the Labrador coast.

The primary responsibility of FFAW-Unifor is to engage in collective bargaining on behalf of our members. A big part of that includes improving fish prices. FFAW-Unifor engages in collective bargaining for most commercial species, including the following:. A Negotiating Committee is established prior to each round of negotiations for each species. Each committee is generally comprised of fleet chairs to ensure fair representation for all fleets and regions. FFAW staff does due diligence in collecting, assembling, and analyzing market reports, and assists the Committee in developing negotiating strategy. The Negotiating Committee attempts to come to an agreement through regular, across-the-table negotiations with the Association of Seafood Producers ASP ; however, bargaining efforts often end up before the Standing Fish Price Setting Panel. Both parties submit a final price to the Panel and argue their sides. The process outlined in the Act was severely flawed because it lacked a reliable mechanism to arbitrate fish prices each year. The need for a Panel was first identified in the Cashin Report.
